SPECIAL REGULAR SESSION MINUTES

A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on July 11, 2007.

The meeting was called to order at 5:03 p.m.

Chairman Anthony Kayser declared a quorum present.  Chairman Kayser appointed Travis Simpson to vote in the absence of Thomas Fitzgerald, And that John Ryan would also be voting.  Commissioner Ryan indicated that he had reviewed the record and was prepared to cote on agenda items. Chairman Kayser stated that the Commission would be voting with seven members.

ZONE CHANGE APPLICATION:  Residence 3 (R-3) to Incentive Development Zone (IDZ) on 1.47 acres of land located at 364 Silver Lane.

Upon a motion by Kathleen Salemi, seconded by Paul J. Roczynski, it was Voted (6-1) to APPROVE the above Zone Change Application.

Commissioner Grottole voted in opposition.


SPECIAL PERMIT USE APPLICATION:  Under Section 402.2 (p) and 402.2 (e) to allow a restaurant/automobile oriented use with drive-through facilities on land located at 364 Silver Lane.

Upon a motion by Elaine Carey, seconded by John Ryan, it was Voted (6-1) to APPROVE the above Special Permit Application with the following conditions:

1.      Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
2.      Provide separate plans for each application – label accordingly.

Commissioner Grottole voted in opposition.

SITE PLAN APPLICATION:  364 Silver Lane, Construction of a 2,506 square foot automobile oriented restaurant, parking lot and associated storm water drainage

Upon a motion by Elaine Carey, seconded by Paul J. Roczynski, it was Voted (6-1) to APPROVE the above Site Plan Application with the following conditions:

1.      Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
2.      Applicant needs to acquire temporary rights from the property owner located at No. 356 Silver Lane for the removal of the old foundation, trees, installation of the storm drainage system and associated grading.
3.      Layout of curb cuts, vehicle tracking movements and drainage calculations are subject to approval by the Connecticut Department of Transportation.
4.      Provide information as to what will happen to the existing gravel drive located along the westerly side of the site.
5.      Provide copies of the entire sectional zoning map as per section 713.3b of the Zoning Regulations - indicate in color the limits of the proposed zone change.

6.      Provide separate plans for each application – label accordingly.
7.      Revise grading along the slope in the basin and along slope of bank - provide a maximum slope of 3:1 – revise and label accordingly.
8.      Revise the zoning data block for Incentive Development Zone requirements.  
9.      Provide labels for proposed retaining walls on the site – include grades on the top of walls and ground elevations.
10.     Provide additional labels and grades for sidewalk ramps along the frontage of Silver Lane.
11.     Provide 1½” lip along the driveway aprons – label grades accordingly.
12.     Provide additional signs for the loading zone area.
13.     Revise location of exit/enter signs outside of the line of sight.
14.     Provide a minimum sidewalk width of 4 feet along the easterly side of the building.
15.     Provide a general note to provide 18” clear distance between all proposed utilities.
16.     Provide dimensions for layout of basins.
17.     Clarify proposed grades of dumpster vs. parking lot – do you want concrete pad 6” above grade?
18.     Provide schedule of pipe for the roof drain and sanitary sewer lateral.
19.     Provide proposed top of frame elevations for resetting sanitary manhole in driveway apron.
20.     Provide top of frame elevations for proposed grease trap structure in driveway.
21.     Provide additional dimensions for the layout of the site.
22.     Provide 6” topsoil for all disturbed areas – revise topsoil note and walk details.
23.     Provide 8” concrete dumpster pad.
24.     Provide (9” at drives) process base on concrete walk and dumpster detail.
25.     Provide dimension for the width of plunge pool – minimum 18’.
26.     Revise construction details for type “C” catch basin – provide 4’ sump.
27.     Provide additional construction details on the plans - type “C-L” catch basin, granite stone curbing, concrete paving block and silt sack.
28.     Revise the “suggested construction schedule” accordingly.
29.     Provide location of test pit on the plans - test pit data on the plans – note location
30.     Provide a heavy duty pavement design – revise detail accordingly
31.     Provide stamped concrete between the edge of road and front of walk – label accordingly.
32.     Provide a dimension of 2 ½’ from the edge of HC parking space to the concrete wheel stops.
33.     Reduce the width of the curb cuts along Silver Lane – label width accordingly.
34.     Provide granite stone curbing along the gutter of Silver Lane. Where trucks cross the curbing, provide 3” reveal on curbing. Label and dimension accordingly.
35.     Provide stamped concrete along that area of the driveway where trucks will track across the driveway – include details and dimensions.
36.     Provide labels and dimensions for limits of 8” reinforced concrete walks where trucks track across the sidewalks.
37.     Check and revise location of proposed trees – several are located in very close proximity of underground utilities.
38.     Provide copies of the entire sectional zoning map as per section 713.3b of the zoning regulations-indicate in color the limits of the proposed zone change.
39.     Site Plan Modification Bond set in the amount of $25,550.00.

DRAINAGE COMMENTS

40.     Provide a standard DOT report for all proposed pipe runs.
41.     Provide pipe sizing calculations for the roof drains

Upon a motion by Kathleen Salemi, seconded by Paul J. Roczynski, it was Voted (6-1) to APPROVE the above Soil Erosion and Sedimentation Control Application with the following conditions:

1.      Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
2.      Provide separate plans for each application – label accordingly.
3.      Provide outlet protection from the roof drain pipe – include details.
4.      Provide lines and labels for erosion control measures at existing and proposed catch basins.
5.      Provide dimensions for layout of basins.
6.      Provide filter fabric around and under stone at the drywell and water quality basin.
7.      Provide name and phone number of contact person responsible for erosion and sedimentation control measures.

Commissioner Grottole voted in opposition.


RESUBDIVISION APPLICATION OF BURNHAM MEADOWS: Preliminary Layout Approval, eight (8) Lots on 9.75 Acres of land located at 347A King Street (corner of Brook Street and King Street)

Applicant: Anthony Jetmore and Ryan Ladd

Upon a motion by Kathleen Salemi, seconded by Elaine Carey, it was Voted (7-0) to APPROVE the above Resubdivision Application Preliminary Layout Approval with the following modifications:

1.      Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
2.      Key map drawn at a scale of 1”=200’ per subdivision regulations section 4.5 is missing.  Refer to section for additional map requirements
3.      Note origin, date, and provide surveyor certification of topographic information.
4.      Logically number sheets within the set.
5.      Provide a 1” = 100’ and 1” = 200’ subdivision plan as per section 5.0I(3) of the regulations.
6.      Revise layout of driveway hammerheads – provide 5’ clear distance from the property lines
7.      Provide additional existing spot grades along the 25’ slope easement.

8.      Revise layout of driveways so as to provide adequate vehicle back up area – use AASHTO P24 vehicle turning template.
9.      Provide subdivision approval block on each sheet.

Title sheet:

10.     Add owner and applicant names, mailing address, and telephone number to sheet.

Overall Plan:

11.     Will subdivision be served by natural gas?  If so, graphically depict gas services on plans as well as existing/proposed gas main within King Street.
12.     Add street trees to plan per subdivision regulation section 8.7 for lots 1, 3, & 4.  Review section for location and type requirements and locate trees to avoid restricting intersection sight distance at the Brook Street intersection.  Reconfigure driveway and service laterals on lot 2 to minimize impacts to existing mature street trees.
13.     The Town is requiring that the applicant mill and overlay that area of King Street where utility patches are required. Provide lines and labels for limits of pavement repairs - add roadway pavement repair detail to plans.
14      Revise grading of lot no. 4 to an average grade of 5% or less.  
15      Add clean-out to grade at points where sanitary lateral exceeds a change in direction of 45 or greater and at 75 foot intervals along the laterals serving lots 4, 5, 6, 7, & 8.  Specify pipe type and ASTM designation along with a minimum slope of 1% on plans.  Provide sanitary lateral trench detail and clean-out to grade detail.  Is sanitary lateral in front of #347 proposed or existing?
16      Provide design elevations for proposed sanitary manhole as well as length/slope information for proposed main in front of lot 1.  Add MDC sanitary manhole and main detail to plans.
17.     Revise water service lateral along driveway of lot 7 to be located within lot boundary.
18.     Graphically depict location of Electric/Telephone/Cable underground conduits serving the proposed lots on plan.  CL&P pole 1953 will need to be relocated to accommodate driveway for lot 5, verify that CL&P has been contacted and has reviewed the current proposal.
19.     Add locations of proposed stone columns with street number placards to plan –columns to be placed outside of the King Street Right-of Way.
20.     Specify on plan turf establishment or other means of long-term stabilization for structures that are specified to be removed.

Subdivision Plan:

21.     Show eastern edge of right-of-way for King Street and southern edge of right-of-way for Brook Street and label widths accordingly per subdivision regulation section 4.6D.1c.
22.     Review all lot line and curve labels, it appears that some are missing.  Also consider a chord bearing and distance for the concentric curves within the center of the parcel.
23.     Revise line weight of abutting parcels to clearly depict parcels of land not included within the subdivision.
24.     Specify responsible entity for conservation easement area on the plans.  Specify portion of lots to be deed restricted instead of identified as a conservation easement.

Stormwater Pollution Control Plan:

25.     Add construction entrances for each proposed driveway to the plan, draft per detail provided in plan set.
26.     Add inlet protection to plan for existing catch basins along King Street property frontage, six catch basins total.  Specify on plan that inlet protection is to be maintained by developer during the duration of construction and will be removed by the developer at the completion of construction.  Add inlet protection detail to plans, silt sack or equivalent is an acceptable device.
27.     Provide adequately sized material stockpile areas for each lot.

Stormwater Pollution Control Plan Notes and Details:

28.     Under general notes, add a note specifying that prior to the commencement of construction a meeting shall be held between the developer, property owner, selected site contractor, and town engineer.  At this meeting the person responsible for maintaining the sedimentation and erosion control measures shall be designated and this person’s information shall be included on the plans.  At that meeting the responsible party’s contact information shall also be provided to the Town Engineer.
29.     Under general notes add note specifying that prior to the commencement of construction, a Call Before You Dig shall be made and provide telephone number.
30.     Revise Notes A & B under land grading from 2:1 slopes to 3:1 slopes per subdivision regulations section 8.8D.
31.     Revise topsoil application note 1 under Topsoiling section.  Note is to specify a minimum of 6” topsoil depth per subdivision regulations.
32.        Revise Erosion & Sedimentation Control Narrative to specify that a construction entrance shall be installed on each of the proposed driveways.  Also, specify that for a period of three months after disturbed areas are seeded, the turf establishment shall be inspected and shall be re-seeded as necessary to the satisfaction of the Town Engineer.  Additionally specify that the developer shall remove the erosion controls after the site has been stabilized to the satisfaction of the Town Engineer.

Soils Data and General Notes and Details:

33.     Well abandonment sequence shall include requirements specified by the Town of East Hartford Health department.
34.     Revise Drywell Detail (refer to detail B-29 within Manual of Technical Design):
Add 24” depth of compacted 2” crushed stone beneath structure.
Specify structure material to be pre-cast concrete with HS-20 loading.
Revise 1” broken stone to specify 2” crushed stone.
Specify 2” crushed stone to be wrapped with a non-woven geo-textile filter fabric.  Fabric to overlap structure by 9” per detail.
35.     Subdivision plan shall be revised to allow only one curb cut on King Street for Lots 5, 6, 7 or Lots 3, 6, 7.

Chairman Kayser abstained from voting.

REVIEW OF CORRESPONDENCE FROM:
Attorney Frank Leone dated June 5, 2007, regarding 700 and 710 Silver Lane
(Postponed from June 13, 2007 Regular Session)

Chairman Kayser recluse himself from this item and Vice-Chairman Carey became acting Chairman. It was the consensus of the Commission to have a workshop in September to discuss Attorney Leone concern. Date of workshop in September to be determined at the August regular meeting.

MISCELLANEOUS

•       Commission review correspondence from Kegazel LLC dated 7-10-07 requesting an extension of time to remove a box trailer located in the rear of 1285 Main Street. It was the consensus of the Commission to grant an additional thirty days.

•       Commission review correspondence from Attorney Joseph Williams dated 7-10-07 regarding whether or not the Incentive Development Zone authorizes modification of Section 223.1. It was the consensus of the Commission that it 604.6 does not authorize a modification to Section 223.1 and that variance would be the only vehicle allow modification.

•       Upon a motion by Kathy Salemi, seconded by John Grottole, it was Voted (7-0) to approve a Site Plan Modification bond for 186 Brewer Street “Cabela’s Boat Facility” in the amount of $112,350.00
